A federal judge has temporarily blocked a new state milk pricing regulation that backers said would have pumped an added $6.7 million annually into the pockets of Pennsylvania’s dairy farmers.

The measure, Order A-968 set by the Pennsylvania Milk Marketing Board, would have changed the way milk dealers and processors pay premiums to the state’s more than 7,000 milk producers.

It would have required that state farmers get premium payments even for out-of-state milk sold in Pennsylvania. Proponents said the measure would help the state’s farmers without boosting prices for consumers.

The Pennsylvania Association of Milk Dealers sued the marketing board in U.S. Middle District Court, claiming the regulation violates the Constitution’s prohibitions against unfairness in interstate commerce.
