FreshDirect Foes Lose In Court

FreshDirect is one step closer to setting up shop in the South Bronx.
A Bronx Supreme Court judge on May 31st dismissed a lawsuit by a community group seeking to block the online grocery's move to the Harlem River Yard in Mott Haven.
The petition by the community group South Bronx United challenged the move from Long Island City, Queens, arguing the city failed to properly analyze the potential environmental impact that would result from a "truck-intensive" business moving in, specifically the impact of noise and air pollution. The community group, which is being represented pro bono by New York Lawyers for the Public Interest, claimed the environmental impact statement from 1993 was out of date and not relevant to the more residential area today.
But Judge Mary Ann Brigantti-Hughes disagreed.
