A federal judge in Milwaukee has denied Dean Foods motion to dismiss an
antitrust case filed against the Dallas-based dairy company by the United States Department of Justice.
Dean Foods attempted to get the suit thrown out of court, alleging the
Department of Justice failed to include facts in its complaint that could
legally support the case going forward.
A judge denied Dean Foods motion to dismiss, but did slam the DOJ for how
the complaint against Dean was laid out. The court in its conclusion said, In
todays world, structural issues, together with a lack of specificity in content
associated with the underlying complaint, simply do not measure up to that which any court would reasonably expect in draftsmanship from an experienced litigator.
