Late yesterday, a federal judge in Texas granted a preliminary injunction delaying the implementation of the DOL’s new overtime rule. This rule seeks to raise the minimum salary requirement to $47,476, which will cost bakers millions, reduce workplace flexibility and workplace advancement opportunities.
Judge issued a preliminary injunction and not a permanent one, meaning the rule could be brought back up in some form. But, this probably would not happen until President Trump takes office, giving bakers an opportunity to work with a Trump-led DOL before any new rule is implemented.
ABA will continue working with Congress and the new administration to ensure that a responsible minimum requirement is achieved.
