Honey Smoked Fish Co. & Einstein Noah Restaurant Group Resolve Dispute

AURORA, Colo. — Rocky Mountain Honey Smoked Fish Company, LLC ("HSF") and Einstein Noah Restaurant Group, Inc. ("Einstein/Noah") have agreed to resolve their dispute concerning the use of the name "Honey Smoked Salmon" amicably and without resort to protracted and distracting litigation through a confidential settlement.

As of today, HSF has dismissed the lawsuit it filed last month in federal court in Denver, Colorado, and it will seek no further legal action against Einstein/Noah.

Einstein/Noah will continue to offer its bagel sandwich with a hot-smoked honey-flavored salmon product, but will do so under a name other than "Honey Smoked Salmon."

No money has changed hands between the parties as part of this negotiated resolution, and the parties have agreed to disagree concerning the merits of their respective legal positions. This settlement in no way constitutes an admission or a comment by either side as to the other side's legal positions.

Both HSF and Einstein/Noah wish each other well in their respective business endeavors, and they have nothing adverse to say about each other.

Both HSF and Einstein/Noah have agreed that they will make no further public statements concerning the lawsuit, its resolution, or the parties' respective positions in the case, other than this statement.
