PrimusLabs has announced the settlement of all civil cases it is involved in related to the 2011 Listeria outbreak originating from cantaloupe grown at Jensen Farms in Holly, Colorado in 2011.  PrimusLabs has been dismissed by the parties from all cases, with prejudice, and has dismissed all cross complaints it had filed against other parties involved in the matter.

The settlement comes prior to any of the scheduled trials beginning, allowing resources that may otherwise be used for litigating to go directly to the Listeria victims and their families.

In-house counsel for PrimusLabs, Ryan Fothergill stated that now that the litigation has come to an end, the company hopes that all parties can move forward, but he also noted that in the future the industry and its players need to be proactive in implementing improvements to monitoring and food safety to mitigate the potential of another tragedy like this happening again. “We believe that much can and should be learned about food safety production and handling practices and supply chain monitoring in the wake of this tragedy”, said Fothergill. He also acknowledged the role that plaintiffs’ attorney Bill Marler made in brokering the settlement. PrimusLabs CEO Robert Stovicek concluded, “We know that no amount of money can make the victims and their loved ones whole, but it is our hope that this settlement and the end of the litigation will provide them some relief.”
