Bankruptcy Judge James Marlar ultimately could be the one who decides whether the Bashas’ supermarket chain emerges from bankruptcy under the control of the Basha family or is sold to competitor Albertsons LLC.
He also could leave the door open for another buyer in a decision that could have a major impact on metro Phoenix’s ultracompetitive grocery market.
An unsolicited offer by Albertsons to buy the 78-year-old Bashas’ chain, along with key creditors’ opposition to Bashas’ reorganization plan, has complicated the Chandler-based grocer’s efforts.
