Is the Broadwater name too broad for a trademark claim? Broadwater Seafood L.C. filed a lawsuit this month against Broadwater Oyster Co. LLC arguing that it alone has the legal right to the “Broadwater” name.
The two oyster sellers both do business on Virginia’s Eastern Shore, which includes a geographic area known as Broadwater.
Broadwater Seafood started in 1988; Broadwater Oyster began in 2010.
