CAMDEN – A federal judge has tossed out lawsuits filed by health-conscious New Jersey consumers who claimed their supermarkets duped them into paying extra for bread by claiming that it was made from scratch in their stores.
The consumers said signs posted in Whole Foods, Wegmans and Acme Markets with phrases like "Baked Fresh in our Oven" or "Made in House Bread" coaxed them into paying a premium price for bread that was frozen and re-heated in the store.
But in a ruling issued Wednesday, U.S. District Judge Joseph Irenas suggested the consumers' claims were half-baked.
