A Calhoun County family-run dairy will get the chance to argue Florida rules governing milk labeling violate its First Amendment right to free speech.
U.S. District Court Judge Robert Hinkle on Monday rejected a motion by lawyers for Agriculture Commissioner Adam Putnam and the head of the state’s dairy bureau to dismiss the lawsuit filed in November by Ocheesee Creamery.
Hinkle found the creamery has standing to bring the suit and also rejected an effort by the state to add the federal government’s Department of Health and Human Services as a party to the legal action.
